1. Licences, Registration & General Conditions
This website is owned and operated by Great Western Custom Homes Pty Ltd (ABN 24 644 452 031, NSW Builder Licence Number 359772C, Trading As Great Western Custom Homes).
Your access to and use of this website (gwcustomhomes.com.au), tender requests, custom architectural consultation services, and digital portals are subject to your compliance with these Terms & Conditions. By browsing this site or requesting a building estimate, you acknowledge and agree to be bound by these General Conditions. Great Western Custom Homes reserves the right to amend these terms at any time.
2. Architectural Copyright & Intellectual Property
All materials displayed on this website — including without limitation all floor plans, facade visual renders, architectural drawings, 3D spatial models, custom inclusions schedules, images, graphics, and text ("Content") — are protected by Australian copyright, trademark, and intellectual property laws.
- All custom home plans and elevations are the exclusive copyright works of Great Western Custom Homes Pty Ltd. No part may be reproduced, modified, republished, framed, or copied without prior written consent.
- Dimensions, room layouts, and floor areas displayed (measured in square meters, m²) are approximate architectural representations subject to final site contour survey and engineering validation.
3. Pricing, Facades & Specification Disclaimers
Initial price estimates or range filters displayed online or provided during preliminary consultations are intended as a guide only and vary based on site location, land slope, and council requirements.
- Illustrative Renders: Images and 3D renders depicted on this website are artist impressions for illustration purposes only. Actual facade materials, color schemes, and rooflines may vary.
- Optional Variations: Images may depict optional upgraded fixtures, finishes, and landscaping features not supplied by Great Western Custom Homes as standard (including alfresco decking, feature fireplaces, window furnishings, swimming pools, and custom joinery).
- Binding Building Contracts: Binding building commitments are issued exclusively via formal HIA (Housing Industry Association) or MBA (Master Builders Association) Fixed-Price Home Building Contracts following receipt of final bore-hole soil reports (Class M, H1, H2, P), AHD contour surveys, and structural engineering sign-off.
4. House & Land Packages & Site Conditions
For advertised House & Land packages:
- Land purchase is subject to a separate contract entered directly between the buyer and the land developer. Great Western Custom Homes provides a separate residential construction contract for the building works.
- Final construction pricing is subject to statutory approvals (DA/CDC), bushfire (BAL) assessment, acoustic reports, and site soil classification.
5. Statutory Warranties & Structural Guarantee
All residential building works undertaken by Great Western Custom Homes comply with the Home Building Act 1989 (NSW) and the National Construction Code (NCC). Qualifying custom homes receive statutory warranties, Home Building Compensation Fund (HBCF) insurance, and structural guarantees subject to site drainage and owner maintenance guidelines.
6. Limitation of Liability
While Great Western Custom Homes makes every effort to ensure the accuracy of website content, information is provided in good faith. To the extent permitted by Australian Consumer Law (ACL), liability for any implied warranty or condition which cannot be excluded is limited to either re-supplying the service or paying the cost of re-supply.
